These general conditions are generally available through the “bulgarian.academy” website and are provided in a way that allows their storage and reproduction. These General Terms and Conditions (hereinafter referred to as “Agreement” or “General Terms”) constitute an agreement between the user and “BULGARIAN EDUCATIONAL KIBERNETIKA” AD, EIK 207326463 regarding the conditions under which “bulgarian.academy” offers the information, goods, and services provided to or through “bulgarian.academy”. These general conditions apply to all goods and services offered on the website.
The “Bulgarian.academy” website is owned and administered by “BULGARIAN EDUCATIONAL CYBERNETICS” AD, EIK 207326463, the commercial company registered in the Commercial Register at the Registration Agency. The present general conditions should also be accepted for notification under Art. 47 of the Consumer Protection Act (CPA). The goods and services are offered only if the present general terms, rules, and clauses in this document are accepted. If you do not agree with these terms or if you are not 18 years old – do not use “bulgarian.academy”.
Users declare that they are familiar with and agree to the definitions of the following terms:
The website (or the site) is a collection of internet pages with a common title internet page, which is loaded in the browser when typing the electronic address https://bulgarian.academy/;
Administrator (of the site) – “BULGARIAN EDUCATIONAL CYBERNETICS” AD, EIK 207326463 within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and for the repeal of Directive 95/46/EC (General Data Protection Regulation).
A user of an internet page or site is any person (visitor to the site, potential buyer or merchant offering their offers, promoting, etc.) who entered the email address or reached the internet page or site through redirection from another website;
Interface – a combination of graphic objects associated with program code, through which the User communicates with the website in a way accessible to him;
Platform – a set of conceptual, programming, and graphic solutions, making up a complete product, providing an accessible environment for the User to the possibilities of the Internet space;
Browser – a software program for a computer, smartphone, or other device, providing the ability to transfer, process, and visualize data using various types of data transfer protocols;
An electronic link is a link indicated in a particular Internet page that allows an automated reference to another Internet page, information resource, or object through standardized protocols;
Malicious actions are actions or omissions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, sending unsolicited mail (unsolicited commercial messages, SPAM), gaining access to resources with foreign rights and passwords, using flaws in systems for one's own benefit or obtaining information (HACK), performing actions that can be qualified as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending “Trojan horses” or causing the installation of viruses, or remote control systems, disrupting the normal work of other Internet users and associated networks, performing any actions that can be qualified as a crime or an administrative violation under Bulgarian legislation or under other applicable law;
An information system / System is any individual device or set of interconnected or similar devices, which, in the execution of a certain program, provides automatic data processing;
Internet page within the meaning of these General Terms and Conditions means a constituent and separate part of a website;
IP Address (“IP address”) is an identification number associating a computer device, Internet page, or resource of the User in a way that allows its localization in the global Internet network;
A password is a code of letters, numbers, and characters, which, together with the username, identifies the User and which, together with the username, serves to access his user profile;
A username is a unique code of letters, numbers, and characters chosen by the User, by means of which he is individualized in his relations with other users and “BULGARIAN EDUCATIONAL CYBERNETICS” AD, EIK 207326463.
Registration is filling in data /username, phone, and email address/ in an online form and obtaining a password for accessing and viewing the content on the “bulgarian.academy” website.
Signing up for a newsletter is an express consent to receive up-to-date information about educational products, goods, and services.
A user profile is a separate part of the website of “BULGARIAN EDUCATIONAL CYBERNETICS” AD, containing information about the User, required by “bulgarian.academy”, stored with him, used and processed in accordance with the privacy policy of the website and in accordance with the current legislation, such as access to the user User profile is created by entering an email address and password.
Cookies – small text files used in accordance with the Cookie Policy to store small pieces of information locally in the User's browser/device, in order for the website to function correctly and provide the best possible services.
Commercial messages – any type of message sent via electronic communication channels (such as e-mail, SMS, email, etc.), containing general and thematic information, information about similar or relevant products, goods, and services to users, information about offers or promotions from “bulgarian.academy”.
Product or Service – any product or service, or digital content located on the “bulgarian.academy” website, which is provided as a result of a concluded sales contract.
Consumer – any natural person who acquires goods or uses services that are not intended for carrying out a commercial or professional activity, and any natural person who, as a party to a contract under the Consumer Protection Act, acts outside the scope of his commercial or professional activity.
Contract – represents a remote contract between “BULGARIAN EDUCATIONAL CYBERNETICS” AD and the user for the purchase and sale of Goods and/or Services through the “bulgarian.academy” website, based on and an integral part of which is the present general conditions of use.
Services and goods offered through “bulgarian.academy”
The “bulgarian.academy” website offers goods with announced prices, and free and paid services, representing educational products for increasing qualifications and acquiring new knowledge and skills. The main characteristics of the goods and services offered on the “bulgarian.academy” website are defined in the profile of each good/service.
To use the services and make purchases of goods offered by “bulgarian.academy”, registration on the website is required. The online registration procedure requires providing a personal e-mail address, first and last name, and contact phone number. By providing the specified data, you declare that they are up-to-date. The provided e-mail address is the means by which you identify yourself in “bulgarian.academy”, and the password is available only to you. In case you forget it or wish to change it, we provide you with this option. We will use the data you provide us during the registration procedure to provide you with personalized services, delivery of goods, contact you in case of need, and if you wish to receive newsletters and commercial messages. In order to place an order for goods and services offered on the “bulgarian.academy” website, the user concludes a sales contract at the address http://www.bulgarian.academy /subdomain: store.bulgarian.academy/ according to the following procedure:
1. Login and identification in the website ordering system;
2. Selecting one or more of the offered goods or services from a category and adding them to a list of goods for purchase;
3. Provision of the necessary data for individualization of the user as a party to the contract;
4. Providing delivery details, if any;
5. Choosing a method and making payment of the price;
6. Order confirmation;
When completing the order, the user has the opportunity to review the products he has decided to purchase, their prices, and the final payment amount, as well as benefit from an additional discount if he has a discount voucher or other promotional code. The user has the right to correct errors when entering information no later than issuing the statement for concluding the contract. The distance sales contract is considered concluded at the moment the user receives his e-mail that the goods from the order are ready for dispatch or the service can be provided.
The contract is concluded in Bulgarian and is stored in the database of the website in the platform.
When purchasing a course and after making payment in the ways listed in item 5 within 3 /three/ working days, you will receive the specific technical steps and instructions for access and complete information on conducting the relevant course, the time of commencement, the methodology of the conducted training, modules, and duration.
The price of the goods and services includes all taxes and fees and is announced in the profile of each good/service on the “bulgarian.academy” website.
The value of the postal or transport costs, not included in the price of the goods, is provided as information to the user when selecting the goods for the conclusion of the sales contract and before finalizing the order. The delivery term is determined for each product separately when concluding the contract with the consumer. For each specific product, the user is notified immediately before the finalization of the order, approximately how many days it will take to deliver it. The indicated days required for delivery are indicative. In the event that no delivery period has been agreed upon, the delivery period for the goods is 30 calendar days, starting from the date following the sending of the order to the user on the “bulgarian.academy” website.
In case of lack of availability of a given product, “bulgarian.academy” reserves the right to refuse the order.
When ordering goods, the user chooses whether to pay for the goods before or at the time of their delivery. When ordering a service, it is provided after payment of the price.
Products from different categories cannot be the subject of one order.
On each page of “bulgarian.academy”, where a specific product or service is presented, a specific price is indicated or it is indicated that the service is free. The paid services of “bulgarian.academy” are provided after advance payment of the price.
1) by bank transfer by bank transfer;
2) with a credit/debit card through ePay (without registration);
3) from a micro account in ePay;
4) by credit/debit card through the PayPal system;
5) via Easypay;
6) on payment through TBI bank.
With respect to the selected payment method involving a third-party payment service provider, the user may be bound by the terms and conditions and/or fees of such third party. “Bulgarian.academy” is not responsible if a payment method involving a third-party payment service provider is unavailable or otherwise does not function for reasons beyond the fault of “bulgarian.academy”.
The user has the right, without owing compensation or a penalty and without stating a reason, to withdraw from the concluded contract within 14 days from the date of receipt of the goods or service.
In the same period, the user should declare the right of cancellation by filling in and sending the Cancellation Form available on the website: “bulgarian.academy” to the following email address: [email protected] or to the address: “Aldemirovtsi” Str. No. 10, fl. 3.
If the right of withdrawal is exercised under a contract for the purchase and sale of goods, the consumer undertakes to return the goods in commercial form. Commercial type means a type that allows the subsequent sale of the goods as new. The unpacking of the goods should not have led to an obvious violation of the commercial appearance of the goods. In the event of a defective commercial appearance of the goods, we have the right at our discretion to refuse to accept a withdrawal from the contract or to charge the consumer the cost of restoring the goods to a commercial appearance. According to Art. 55, para. 4 of the Consumer Protection Act, the consumer is responsible for the reduced value of the goods caused by testing them other than what is necessary to establish their nature, characteristics, and good functioning. When returning the product, the user undertakes to return it together with the complete set received, as well as all accompanying documents – receipt, invoice, receipt-handover report, and warranty card (if any).
– for the delivery of goods made to the order of the user or according to his individual requirements;
– for the delivery of sealed goods that have been unsealed and/or tested after their delivery and cannot be returned for hygiene or health protection reasons.
If you cancel this contract, you will be refunded the price paid for the returned goods, including the cost of delivery (excluding any additional costs associated with a delivery method chosen by you other than the cheapest standard delivery method offered by us). , without undue delay and in any case no later than 14 days from the date on which you inform us of your decision to withdraw from this contract and in the event that we have already received back the goods subject to the contract. You will receive a refund to your bank account. We have the right to delay refunds until we receive the goods back or until you provide us with evidence that you have sent back the goods, whichever is earlier.
Right to complain about goods
The user has the right to claim for any non-compliance of the goods with what was agreed/ordered when after delivery, non-compliance with the sales contract is discovered. When submitting a complaint, the complete set of documents (including receipt/invoice, delivery protocol, warranty card, etc.), as well as the goods, should be sent to the address of the sender written on the relevant order.
Goods that are subject to warranty service are accompanied by the necessary documents with information on the warranty period (according to Bulgarian legislation), the conditions, and the place of warranty service.
The warranty is valid only for manufacturing defects and non-conformities existing during the delivery of the goods and appearing during normal operation on the territory of the Republic of Bulgaria. The warranty is void and the customer pays the cost of repairs in case of damage caused by: improper use and/or improper storage, spilled liquids; or attempted repair by persons lacking the appropriate competence.
The contents of this website, including images, design, graphics, text, formatting, sounds, photographs, images, software, and other materials and information, and the selection and arrangement thereof, are protected by copyright. All rights to the content of the website are reserved, as well as to the training you purchase. BULGARIAN EDUCATIONAL CYBERNETICS AD has the right to compensation for damages resulting from the use of the site in violation of its rights.
BULGARIAN EDUCATIONAL CYBERNETICS JSC reserves the right to make periodic changes to these General Terms and Conditions and the Privacy Policy for using bulgarian.academy,
In the event of a change, the updated version will be published on the website and will be effective from the date of the last change. Using the website after the update has been published means that you agree to the changes made.
When using the services of bulgarian.academy, which is accessible without registration, any change in the general terms and conditions and the privacy policy is in effect without the need for explicit notification.
Bulgarian legislation is applicable to this contract. By accepting these general terms and conditions, the user understands and agrees that bulgarian.academy can transfer all of its rights and obligations arising on the basis of these terms and conditions to another company or a third party that is part of the bulgarian.academy group of companies. Any disputes arising between bulgarian.academy and users will be resolved by mutual agreement, or if this is impossible, the disputes will be resolved before the competent Bulgarian courts.
